Integral Privacy Notice

Abogadas Fideicomisarias S. de R.L. de C.V. (hereinafter LST MEX) with address located in Avenida Misión del Carmen, Plaza Navah Local 7, C.P. 77714 Playa del Carmen, Quintana Roo, Mexico. Is responsible for the care of personal information and performs the treatment of this with strict adherence to the principles of consent, information, quality, quality, purpose, loyalty, lawfulness, responsibility and proportionality also to the duties of confidentiality, security and other guidelines of the Federal Law on Protection of Personal Data Held by Private Parties, the Regulations as well as national and international standards on protection of personal data, therefore we provide the following information:

   1.- Personal Data

If you access our website www.lstmex.com and/or request information about our legal, migration, corporate and real estate services, LST MEX collects the following personal data:

  • Name
  • Telephone number
  • Your Email address
  • User of social networks (Instagram, Whatsapp and Facebook)
  • Udemy platform user
  • Video recording
  • Image
  • Voice

If you hire our legal services, LST MEX collects the following personal data:

  • Name
  • Telephone number
  • Your E-mail address
  • Occupation
  • Marital Status
  • Official Identification (voting card or passport)
  • Proof of address (phone line, water or electricity)
  • CURP (Unique Population Registration Number from México)
  • Name and power of attorney of the legal representative
  • Marriage certificate
  • Video recording
  • Image
  • Voice

 Financial and/or patrimonial data:

  • Tax ID number
  • Proof of tax situation
  • RFC (Registro Federal de Contribuyentes) (Federal taxpayer identification number)
  • Proof of payment
  • Bank account statement
  • Financial information about the origin of your financial resources
  • Bank account number
  • Name of the bank
  • Property deed

In addition to the above, if you are a foreigner, the following will also be requested:

  • Mexican immigration form
  • Driver’s license
  • Social Security Number
  • Federal taxpayer identification number from your home country

2.- Purposes of the treatment

It is important for LST MEX to inform you the purposes for which your personal data will be processed regarding our immigration, real estate and corporate legal services; therefore, if you do not wish to provide us with the information requested, we will be unable to offer such services.

  • Video calls to follow up on contracting or legal advice.
  • Contact
  • User generation and identification within our platform.
  • Review the status of the hired legal service
  • Share reviews of our courses or services with the public
  • Filing procedures before governmental institutions
  • File creation
  • Billing 
  • Collection
  • Payment 

Secondary:

  • Subscription to our newsletter
  • Advertising and marketing purposes
  • Invitation and participation in our courses, training, conferences, webinars and events related to our legal services.

For our remote consulting, contract follow-up and virtual events we also collect image, voice or video recording.

3.- Children and mentally impaired persons

LST MEX is a firm committed to safeguard the privacy of minors and mentally impaired persons; therefore, we neither intentionally collect nor process their personal data without explicit consent of their parents, guardians or legal representatives. If you are a parent, guardian or legal representative of a child or mentally impaired person, and you know that they have provided us  personal data without your consent, you may request us to cancel such data at the following e-mail address: rgarza@lstmex.com.

  • Identification data: name, home address, date of birth, land and/mobile telephone numbers, fax number, e-mail address, image.
  • Education data: academic background, university degree, professional certificates, area of specialization, diplomas.
  • Employment data: position, work address, e-mail address, work telephone or mobile numbers and fax numbers, employment background.
  • Billing data: entity to which fees will be billed, tax  address, federal taxpayer identification number.
  • Financial data: bank account information, payment method.

4.-Transfers

LST MEX may transfer your personal data to third parties with whom the firm has a legal relationship, only for the purposes described in this Privacy Notice or in the one made available for you. LST MEX may also transfer your personal data when such transfer is specifically provided by the Law.

5.- Limitation of use and disclosure of personal data and right to revoke the consent

You may revoke your consent to the processing of your personal data or limit the use and disclosure of the same, at any time, provided that it does not involve the impossibility of fulfilling obligations arising from the legal relationship in force between you and LST MEX.

The procedure for exercising your rights will be the same as in section 6.

6.-Procedure for the exercise of ARCO Rights.

In order to exercise your rights of Access, Rectification, Cancellation and Objection, it is necessary to send a request to the e-mail address: rgarza@lstmex.com, with the following requirements:

  • Full name
  • Documents proving your identity (official identification), or in your case, legal representation (power of attorney or power of attorney signed by two witnesses).
  • Clear and precise description of the right to be exercised.
  • Attach any other element or document that facilitates the location of the personal data and supports the origin of your request.

LST MEX will communicate the validity or invalidity of the request within twenty working days, counted from the date we receive your request, such response will be notified via e-mail address. If the request is accepted, it will be effective within fifteen working days from the date on which we communicate the response, if the information in the request is erroneous or insufficient, or if the documents are not accompanied or the requirements are not met. LST MEX will request the correction of such information within five working days of receipt of your request.

For ease of reference, ARCO rights are briefly described as follows:

  • Access. To be informed about personal data stored in LST MEX’s database, how such data are used, their source and communications made using such data and, in general, the conditions and general characteristics of the processing.
  • Rectification. To correct or update your personal data if they are inaccurate or incomplete.
  • Cancelation. To remove your personal data, in whole or in part, from LST MEX’s database whenever it is considered that they are no longer being processed in accordance with the principles and obligations set forth by the Law.
  • Objection. To oppose, for a legitimate reason, to the processing of your personal data.

8.- Retention and security of Personal Data

LST MEX will keep the Personal Data for the time necessary to carry out the purposes mentioned in this privacy notice.

The Personal Data processed by LST MEX will be protected by adequate administrative, technical and physical security measures against damage, loss, alteration, destruction, unauthorized use, access or treatment, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties and the Regulations of the Federal Law on Protection of Personal Data Held by Private Parties, the administrative regulations derived from the same, the commercial legislation and secondary rules issued by the competent authorities.

9.- INAI

In the event that the Data Subject considers that his or her right to the protection of his or her Personal Data has been violated by the improper processing thereof, youhe or she may file a complaint or report before the National Institute for Transparency, Access to Information and Protection of Personal Data,  you may consult the website www.inai.org.mx for further information.

10.- Changes to the Privacy Notice

LST MEX may modify, update or make any changes to the content and scope of this privacy notice. You may consult them on our website www.lstmex.com
